Terms of Service

These Terms of Service ("Terms") govern your access to and use of TinyBell ("Service"), operated by TinyBell SRL (Dominican Republic) ("Company", "we", "us"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Description of Service

TinyBell provides hotel direct booking conversion widgets — including Image Campaigns, Call to Action widgets, and A/B testing tools — that hotel professionals install on their websites to increase direct reservations and reduce reliance on OTA commissions. The Service is provided as a software-as-a-service (SaaS) subscription.

2. Eligibility

You must be at least 18 years old and able to enter into legally binding contracts. By using TinyBell, you represent that you are acting on behalf of a hotel, hospitality business, or related enterprise and have the authority to bind that entity to these Terms.

3. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate, current, and complete information during registration and keep it updated. Notify us immediately at info@thetinybell.com if you suspect unauthorised access to your account.

4. Subscriptions and Billing

TinyBell is offered on a recurring subscription basis (monthly or annual). Your subscription renews automatically at the end of each billing period unless you cancel before the renewal date. You authorise us to charge your payment method on a recurring basis.

All fees are exclusive of applicable taxes (VAT, GST, etc.), which may be added at checkout based on your billing address. Prices are displayed in EUR unless otherwise specified.

5. Cancellation and Refunds

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain full access until then. We do not offer pro-rated refunds for partial billing periods, except as required by applicable law. If you cancel within 14 days of your initial subscription (EU consumer right of withdrawal), contact us for a full refund.

6. Acceptable Use

You agree not to use TinyBell to:

• Promote illegal activities, discriminatory content, or content that violates third-party rights
• Send spam or unsolicited messages to hotel website visitors
• Circumvent, reverse-engineer, or attempt to gain unauthorised access to the platform
• Use the Service in a way that damages, disrupts, or overloads our infrastructure
• Resell or sublicense the Service without our written consent
• Use the Service for any property or business type other than hotels and hospitality establishments

7. Pixel Installation and Your Website

You are responsible for correctly installing the TinyBell pixel on your hotel website and for ensuring compliance with applicable cookie consent and data protection laws on your website. You must maintain a valid privacy policy on your hotel website disclosing the use of third-party analytics and conversion tools.

8. Intellectual Property

TinyBell and all associated software, designs, logos, and content are the intellectual property of TinyBell SRL (Dominican Republic) These Terms do not grant you any rights to our trademarks, trade names, or branding. You retain ownership of all content you upload (images, text) to the platform; by uploading, you grant us a limited licence to display and serve that content as part of the Service.

9. Service Availability

We target 99.9% monthly uptime for the widget delivery network. Planned maintenance will be communicated in advance. We are not liable for downtime caused by circumstances beyond our reasonable control (force majeure), including third-party infrastructure failures.

10. Limitation of Liability

To the maximum extent permitted by law, TinyBell's total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the fees paid by you in the 3 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost revenue, lost bookings, or lost profits.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available". We make no warranties, express or implied, regarding the Service's fitness for a particular purpose, accuracy of analytics data, or that use of the Service will result in increased bookings or revenue.

12. Termination

We may suspend or terminate your account if you breach these Terms, fail to pay fees when due, or use the Service in a way that poses a risk to other users or the platform. We will give reasonable notice where possible. You may terminate your account at any time via account settings.

13. Governing Law

These Terms are governed by the laws of the Dominican Republic. Any disputes shall be submitted to the competent courts of Santo Domingo, Dominican Republic. EU and EEA consumers retain any mandatory consumer rights they have under their local law, including EU Directive 2011/83/EU on consumer rights. 14. Changes to Terms

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Your continued use of the Service after the effective date constitutes acceptance.
